Is Surrogacy legal everywhere in the US? Sanford M. Benardo, a lawyer who specializes in assisted reproduction law, explains how and why surrogates can live in some states but not others, the differences between statutes and case law in some states, and which states are currently the most ideal for surrogacy. Compensated surrogacy has been illegal in NY since the late 1990s but there is new legislation proposed in Albany that would change that. Sanford explains that intended parents can live in any state of country, but surrogates can only reside and embryo transfers may only be performed in states where compensated surrogacy is allowed.
