힘들게 받은 영주권이지만 포기를 해야 할 경우가 있습니다.
영주권자가 해외에 장기체류하거나 혹은 다른 사유로 인해 영주권을 포기하고자 할 때에는 영주권을 이민국에 자진하여 포기 할 수 있습니다.
여기에서 해외 장기 체류라 함은 통상적으로 6개월 이상 지속적으로 해외에서 체류하는 것을 뜻합니다.
6개월 이상 해외에서 체류할 경우에는 미국 영주 의도가 없다고 추정 할 수 있습니다.
1년 이상 해외 장기 체류하면서 미국 재입국을 하지 않을 경우에는 영주권의 포기 의사가 있다는 것으로 간주할 수 있습니다.
