This is not always the case. In the state of Illinois, the court can divide marital property based on what is equitable, which does not mean the same as “equal.” The word equitable means: what is fair under the circumstances. First, the court will take into consideration many different factors when deciding how to divide a divorced couple’s marital property. Some of the factors that are considered are the income of each party, the nonmarital property of each party, and the age and health of each party. However, a 50/50 split or equal division of property, usually ends up being what is equitable for most parties.
