Court halts sale of muslim property in Kampala amid fraud dispute

The Court of Appeal in Kampala has issued an injunction, temporarily halting the sale of prime Muslim property in Kampala city. The decision follows an application by the Uganda Muslim Supreme Council, which aimed to prevent businessman Justus Kyabahwa from auctioning their property. The council owed Kyabahwa 19.2 billion shillings due to a fraudulent land transaction.

The three presiding justices, Deputy Chief Justice Richard Buteera, Geoffrey Kiryabwire, and Irene Mulyagonja, granted the application but reserved the detailed reasons for overturning their colleague Justice Christopher Gashirabake's decision for a later date.

The Uganda Muslim Supreme Council, dissatisfied with Justice Gashirabake's ruling, appealed before a panel of three justices. This temporary relief means Kyabahwa cannot attach the Muslim property until the final hearing and disposal of the appeal challenging the commercial court's judgment. The judgment had condemned the Uganda Muslim Supreme Council to pay Kyabahwa 18.9 billion shillings for failing to provide vacant possession of a piece of land sold to him in Ssembabule.
