The Surrogacy Regulation Act, 2021 is a law that regulates surrogacy in India. It was passed by the Indian Parliament in 2021, and it replaces the Surrogacy Regulation Bill, 2019. The Act allows surrogacy in certain cases, such as for couples who have been married for at least five years, are Indian citizens, and are unable to conceive a child. Surrogacy is also allowed for widows and divorcees who meet certain criteria.

The Act sets up a National Surrogacy Board and State Surrogacy Boards to regulate the practice of surrogacy in India. The Boards will be responsible for granting licenses to surrogacy clinics, monitoring their activities, and ensuring that surrogates are not exploited.

Under the Act, surrogacy clinics will have to comply with certain standards and guidelines, and will be subject to periodic inspections. The Act also lays down the rights of surrogates, including the right to receive medical care, nutrition, and counseling. Surrogates will also have the right to refuse to undergo any medical procedure or intervention that is not in their best interests.

The Act prohibits commercial surrogacy, and only allows altruistic surrogacy, which means that surrogates can only be reimbursed for their medical expenses and other reasonable expenses. The Act also prohibits foreigners, homosexual couples, and single individuals from availing of surrogacy services in India.

Overall, the Surrogacy Regulation Act, 2021 is a comprehensive law that seeks to regulate surrogacy in India in a manner that is ethical and protects the rights of all parties involved.
