Mediation and Conciliation Proceedings

Every mediation proceedings should be conducted in fair, unbiased and impartial manner.

In case there is any threat or pressure during the mediation proceedings then what legal remedies one can avail.

Below are some legal remedies a person can avail in case there is any kind of pressure or threat in mediation proceedings from any side.

1. Immediately inform the concerned Mediator

2. Immediately inform the Chief Judicial Magistrate cum Secy, Legal Service Authority

3. Always make written communication

4. While making written communication one can keep the District Judge in the Loop.

5. Party can opt out of mediation proceedings.

6. An application can be moved in the Court stating all the facts and requesting the court to recall the case from mediation.

7. Lastly, in case some illegal act or offence has been committed during the mediation proceedings then criminal complaint can also be filed before appropriate authority.

So these are some legal remedies which a person can take if he/she feels that there is some kind of pressure or threat in the mediation proceedings.

The person need to be cautious and take a firm stand that it will not be tolrated and there are legal options as discussed above to ensure that proceedings are conducted in fair and impartial manner without any pressure or threat etc.
