"In light of this opinion, we are expecting additional appeals from the Trump team, including up to potentially the U.S. Supreme Court, that could delay the scheduling of any trial by weeks, if not months. Both sides are keeping a close eye on the political calendar. Trump is, of course, the Republican frontrunner in the 2024 presidential race, and he and his lawyers are trying hard to postpone each of his cases as far back as possible, including until after the election, if possible. Jack Smith's team, by contrast, is trying to get this case resolved this year and is looking to try to get it scheduled. It had initially been on the calendar for March, but that date no longer holds. So now everyone is waiting to see when that trial will now be scheduled for."

STORYLINE:
A federal appeals panel has ruled that Donald Trump can face trial on charges that he plotted to overturn the results of the 2020 election, rejecting the former president’s claims that he is immune from prosecution.

The decision marks the second time in as many months that judges have spurned Trump’s immunity arguments and held that he can be prosecuted for actions undertaken while in the White House and in the run-up to Jan. 6, 2021, when a mob of his supporters stormed the U.S. Capitol. But it also sets the stage for additional appeals from the Republican ex-president that could reach the U.S. Supreme Court. The trial was originally set for March, but is already expected to be delayed weeks or months.
