When a potential clients come to me with a problem with their investment portfolio, they are frequently surprised to learn that when they opened up their brokerage account, they had signed an arbitration agreement, which states that they are going to submit their claims to FINRA arbitration and that they had waived their right to file their case in court and to have their case decided by a jury of their peers. FINRA, which is the governmental agency that oversees to brokerage industry, also operates the largest securities investment arbitration dispute forum, where any and all disputes with brokerage firms and customers are decided.
