Florida Statute 517 is the Florida Securities Investor Protection Statute, and it is intended to protect investors from stock broker misconduct. This statute is somewhat unique in that it allows the prevailing party in an arbitration claim to recover their attorney's fees. Accordingly an investor can recover their attorney's fees if a FINRA arbitrator finds a violation of the statute. However, although rarely awarded, if a arbitrator determines that the investor has improperly brought the claim, where there was otherwise not a violation of the statute, it is possible for an arbitrator to award attorney's fees to the other side. |
