FINRA arbitration is intended to be final and binding on all the parties. According... while as a matter of law, a FINRA arbitration award can be appealed if the party appealing the case can either prove some form of misconduct on the part of the arbitrator, or the failure to disclose a bias that impacted the arbitrator's decision. The practical reality is that almost all of FINRA arbitration awards are satisfied by the party, and the few cases that are appealed to the courts are rarely awarded, unless that arbitrator did something, or failed to disclose something, that materially impacted that final decision. |
